Judge Aileen M. Cannon Renders Decision on Trump’s Special Master Request…Winning!

Well, the jury’s not in, but the Judge has declared. Judge Aileen M. Cannon, a U.S. District judge from the Southern District of Florida, came back to her bench with some bad news for the Department of Justice (DOJ). She ordered that a special master be appointed to review the documents seized by the FBI at the raid last month on former president Donald Trump’s Mar-a-Lago estate. 

This news means that the DOJ will have to stop its investigation, even though they have indicated that it has already been done. 

The job of the special master will be to “review the seized property, manage assertions of privilege and make recommendations thereon, and evaluate claims for return of property.” 

The order from the court stated, “The Court hereby authorizes the appointment of a special master to review the seized property for personal items and documents and potentially privileged material subject to claims of attorney- client and/or executive privilege.”

It continued, “Furthermore, in natural conjunction with that appointment, and consistent with the value and sequence of special master procedures, the Court also temporarily enjoins the Government from reviewing and using the seized materials for investigative purposes pending completion of the special master’s review or further Court order.”

The DOJ worked against this decision by highlighting the national security risk. Trump’s lawyers argued, that the government “twists the framework of responding to a motion for a Special Master into an all-encompassing challenge to any judicial consideration, presently or in the future, of any aspect of its unprecedented behavior in this investigation.”

Judge Cannon was nominated by then President Donald Trump in May 2020 and confirmed by the Senate in November 2020. She has requested that Trump’s attorneys and the DOJ submit a joint filing by Friday with a list of proposed candidates for the role of the special master.
